1. Agreement to these terms
These Terms of Service (“Terms”) are an agreement between you and AetherDesignLab LLC, a Wyoming (USA) limited liability company doing business as Content Boost (“Content Boost”, “we”, “us” or “our”).
By using our website at contentboost.org (the “Website”), connecting a social media account to Content Boost, or using our services, you agree to these Terms. If you are using our services on behalf of a business, you agree to these Terms on behalf of that business, and “you” refers to that business. If you do not agree, do not use the Website or our services.
2. Description of the service
Content Boost is a social media management agency. We schedule and publish content to TikTok, Instagram and LinkedIn on behalf of our clients (the “Service”).
The Service is agency-managed. It is operated by the Content Boost team using an internal scheduling and publishing tool that we built and operate ourselves. The tool is not offered as self-serve software, and clients do not log in to it. Clients connect their social media accounts through each platform’s official authorization (OAuth) screen, and we never ask for or store social media passwords.
The specific services, deliverables and schedule for each client may be described further in a separate agreement, proposal or quote (an “Order”). If an Order conflicts with these Terms, the Order controls for that engagement.
3. Eligibility
You must be at least 18 years old to use the Service. If you use the Service for a business or other organization, you confirm that you have the authority to bind that organization to these Terms.
4. Client authorization and responsibilities
When you connect a social media account or send us content to publish, you confirm that:
- you own each connected account, or are authorized by its owner to manage it and to grant Content Boost access to it;
- you own, or have all the rights, licenses and permissions needed for, all content we publish for you, including any music, images, video, trademarks and the likeness of any person who appears in it;
- your content complies with applicable laws and with each platform’s terms of service, community guidelines and advertising or branded-content policies (including any required disclosures for paid partnerships); and
- the information you give us is accurate, and you will tell us promptly if your authorization to manage an account ends.
5. Content approval and our right to refuse
We publish only content that you have approved. You are responsible for reviewing content, captions, dates and times before you approve them. Once approved, content is published as scheduled unless you ask us to change or cancel it before the scheduled time.
We may refuse, delay or remove scheduled content if we reasonably believe that it is unlawful, infringing, harmful, deceptive, or in breach of a platform’s rules or of these Terms. We will tell you when we do this.
6. Third-party platforms
The Service depends on application programming interfaces (APIs) and services provided by third parties, including TikTok, Meta (Instagram and Facebook) and LinkedIn. These platforms are not controlled by us. Your use of them is governed by their own terms and policies.
We are not responsible for platform outages, API changes or limits, changes to platform policies, or any action a platform takes on your account, such as removing content, restricting features, or suspending the account. If a platform change prevents us from publishing as scheduled, we will tell you and work with you on an alternative where possible.
TikTok, Instagram and LinkedIn are trademarks of their respective owners. Content Boost is not affiliated with or endorsed by them.
7. Acceptable use
You agree not to use the Website or the Service, or ask us to publish content, that:
- breaks any law or regulation, or infringes anyone’s intellectual property, privacy or publicity rights;
- is defamatory, hateful, harassing, sexually explicit, violent, or harmful to minors;
- is spam, misleading, fraudulent, or designed to manipulate platform features (for example, fake engagement);
- contains malware or attempts to interfere with, probe or gain unauthorized access to the Website, our tool or any platform; or
- breaches the terms, community guidelines or policies of TikTok, Meta, LinkedIn or any other platform we publish to.
8. Intellectual property
Your content stays yours. You keep all ownership rights in the content you provide to us. You grant AetherDesignLab LLC a limited, non-exclusive, worldwide, royalty-free license to store, copy, format, resize and publish your content solely to provide the Service to you. This license ends when the content is deleted from our systems, except for content already published on a platform, which remains under that platform’s terms.
Our brand stays ours. The Content Boost name, logo, Website and scheduling tool are owned by AetherDesignLab LLC and are protected by intellectual property laws. These Terms do not give you any right to use them except as needed to receive the Service.
9. Fees
Fees, payment terms and any minimum commitments for the Service are set out in a separate agreement, proposal or quote with each client. Nothing on the Website is an offer to provide services at a particular price.
10. Disclaimers and limitation of liability
Disclaimers. The Website and the Service are provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not guarantee any particular results, such as reach, views, followers or engagement, and we do not guarantee that publishing will always be uninterrupted or error-free.
Limitation of liability. To the fullest extent permitted by law, AetherDesignLab LLC will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data, goodwill or followers, arising out of or related to the Website or the Service. Our total liability for any claim related to the Service is limited to the amount you paid us for the Service in the three (3) months before the event giving rise to the claim.
Some jurisdictions do not allow certain disclaimers or limitations, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.
11. Indemnification
You agree to defend, indemnify and hold harmless AetherDesignLab LLC and its members and contractors from any claims, damages, losses and expenses (including reasonable legal fees) arising from: (a) content you provide or approve for publishing; (b) your breach of these Terms or of any platform’s terms; or (c) your lack of authorization to manage a connected account.
12. Termination
You may stop using the Service at any time by telling us by email and revoking our access in each platform’s settings. We may suspend or end the Service if you breach these Terms, if a platform requires us to, or with reasonable notice for any other reason, subject to any Order in place.
On termination, we stop publishing to your accounts, disconnect them from our tool, and delete your access tokens, account data and any scheduled or unpublished content within 30 days, as described in our Privacy Policy. Content already published stays on the platform until you delete it there. Sections that by their nature should survive (such as intellectual property, disclaimers, limitation of liability, indemnification and governing law) will survive termination.
13. Governing law
These Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-law rules. The state and federal courts located in Wyoming have jurisdiction over any dispute arising from these Terms, unless applicable law requires otherwise.
This does not limit any mandatory consumer protection rights you may have under the laws of your country of residence.
14. Changes to these terms
We may update these Terms from time to time. We will post the updated Terms on this page and change the “Last updated” date at the top. If the changes are significant, we will notify our clients by email before they take effect. Continuing to use the Service after the changes take effect means you accept the updated Terms.
